ArcRx — Clinic Use Agreement v5 ← Back to app

ArcRx — Clinic Use Agreement (v5)

Provider: White Coat Library, Lucknow, Uttar Pradesh, India ("ArcRx", "we").

Clinic: the clinic whose administrator accepts this agreement in the app ("the clinic", "you").

Version 5 — 14 October 2026. Replaces v4. What changed: new clauses 15 (online consultations), 16 (patient form and prescription check) and 17 (voice typing); clause 13 — every user also accepts on their own login. (v4, 12 Oct 2026: paid subscription, no free trial.) Pending final legal review — wording may be refined; any material change is shown in the app for fresh acceptance.

1. What ArcRx is

A patient-records, prescription, billing, stock and follow-up tool, licensed to your clinic — not sold. It is not a medical device and gives no medical advice. Clinical templates, drug lists, scales and guidance inside the app are reference material prepared for convenience; they are not a substitute for clinical judgement.

2. Medical responsibility

All diagnosis, treatment, prescriptions and clinical decisions are solely the responsibility of the clinic and its doctors. No template may be used until a doctor at the clinic has read and approved it in the app; approval is recorded under that clinic alone. ArcRx has no medical liability whatsoever.

3. Your data is yours

All patient records entered by your clinic belong to your clinic. ArcRx hosts and syncs them as a Data Processor under your instructions and does not read, use, sell or share them, except (a) for technical support when you ask for it, or (b) where the law requires. You can export all your data at any time from Settings → Data Management.

4. Anonymised counts (what ArcRx can see)

To run and improve the service, ArcRx sees counts only: number of visits, prescriptions, bills, app version per login, pages used, and error reports. ArcRx never sees patient names, phone numbers, addresses or individual records. Optionally, with the clinic's consent, anonymised aggregated trends (age groups, common diagnoses and outcome counts, only in groups of five or more patients; psychiatry and other sensitive diagnoses excluded) are included in service-wide statistics. The clinic can switch this off at any time in Settings → ArcRx privacy & sharing.

5. Your legal duties (DPDP Act, 2023)

Your clinic is the Data Fiduciary for its patients. You must: collect data lawfully and for stated purposes; take patient consent (the app helps you record it, in English and Hindi); obtain a parent's or guardian's consent for patients under 18; send reminders or bills only to the patient's own verified number; honour patient requests for access, correction or deletion; and keep records only as long as needed. ArcRx helps you meet these duties but is not responsible for your compliance.

6. Staff, logins and devices

Each person uses their own login; roles (admin, doctor, staff) are per login. The clinic is responsible for its staff's use of the app, for keeping devices locked and not shared outside the clinic, and for removing access when someone leaves.

7. Billing accuracy

Bills, fees, GST on medicines, stock and expense entries are made by the clinic; the clinic is responsible for their accuracy and for its own tax compliance.

8. Subscription and payment

9. Service "as is" and sub-processors

ArcRx takes reasonable care — per-clinic data isolation, encrypted connections, secure cloud hosting, access logs — but does not guarantee uninterrupted or error-free service. The app works offline after first login and syncs when the internet returns; keep every device online regularly. Internet and device failures are outside ArcRx's control. ArcRx uses the following sub-processors: Supabase (database and authentication), Netlify (app hosting), Razorpay (payments, only when used). ArcRx will tell the clinic in the app before adding a sub-processor that handles patient data.

10. Security incidents

If ArcRx becomes aware of a breach affecting the clinic's data, it will inform the clinic's administrator without undue delay with what is known, so that the clinic can meet its own notification duties under the DPDP Act.

11. Limitation of liability

ArcRx's total liability for any claim arising from this agreement or the app is limited to the fees paid by the clinic in the 12 months before the claim, except for liability that the law does not permit to be limited. ArcRx is not liable for indirect or consequential loss, loss of data caused by the clinic's devices, or loss of business.

12. Leaving

Either side may end use with 30 days' notice. On exit ArcRx will give the clinic an export of its data (if requested) and then delete the clinic's cloud data within 60 days, except what must be retained by law (for example invoices).

13. Changes and acceptance

If this agreement is updated in a material way, the app shows it again for fresh acceptance. Acceptance in the app by the clinic's administrator — who confirms they are authorised to bind the clinic — has the same effect as a signature. The date, version and login of acceptance are recorded. Every user of the app also accepts this agreement on their own login; the administrator's acceptance is what binds the clinic.

14. Law and disputes

This agreement is governed by the laws of India. Courts at Lucknow, Uttar Pradesh have exclusive jurisdiction, subject to any rights under the Consumer Protection Act or the DPDP Act that cannot be excluded.

15. Online consultations

ArcRx provides booking, a patient form, records and an e-prescription for online consultations; the call itself takes place on WhatsApp or Google Meet and is never recorded by ArcRx. Each online consultation is the clinic's and its doctor's or physiotherapist's own practice: they follow the Telemedicine Practice Guidelines and other applicable law (identifying themselves and the patient, recording consent, prescribing only what the consultation mode allows — controlled medicines are blocked — and asking the patient to visit in person when an examination is needed). The clinic sets its own online fees and refund rule, which are shown to the patient before paying; payments go directly to the clinic and ArcRx does not handle them. Only the last 4 characters of a patient's ID are recorded.

16. Patient form and prescription check

The patient's pre-consultation form and the pharmacy's prescription-check page are web pages reached only through a private link. They show only what is needed — clinic, doctor, time and the patient's first name on the form; the patient's initials and the prescription lines on the check page. Form answers are kept with the patient's record; a form link stops working 24 hours after the appointment.

17. Voice typing

Voice typing uses the speech service of the user's own phone or browser (for example Google or Apple), which may process the audio on its servers. Clinicians speak clinical findings only, not names, numbers or addresses; medicines are never filled by voice. The clinic can switch voice typing off in Settings.
